Rainbow Media Terms and Conditions

Thank you for choosing Rainbow Media for your real estate media services. By booking our photography, videography, or related services, you agree to be bound by the following terms and conditions. Please take a moment to review them before finalizing your booking.

1. Introduction

Rainbow Media provides professional real estate media services, including photography, videography, and drone imagery. These terms and conditions govern the services provided by us, and by booking a session, you acknowledge that you have read, understood, and agreed to these terms.

2. Booking and Scheduling

​

2.1. Booking Process:
To book your session, please submit a request through our online booking system at https://rainbowphotography.setmore.com or via email to floriano.esse@bwrm.com.au. We will confirm your booking by reviewing the details, including the date, time, location, and services required.

2.2. Scheduling:
While we strive to accommodate your preferred timing, availability will be subject to scheduling constraints. Please be aware that same-day or next-day bookings cannot always be guaranteed.

2.3. Confirmation:
Once we confirm the details of the booking, the session is considered scheduled.

3. Payment Terms

​

3.1. Pricing:
The costs for our services includes GST and will be discussed and agreed upon during the booking process. We will issue an invoice for direct payment upon completion of the session, Payment can be made via bank transfer.

​

3.2. Cancellation Policy:
If you need to cancel a session, we kindly ask for at least 24 hours' notice. Cancellations made within 24 hours will incur a $100 cancellation fee.

​

3.3. Late Payment:
Invoices are due within 14 days of the session. Payments received after this period will be subject to a $70 late fee for each additional week.

4. Property Readiness

​

4.1. Preparation:
The Client is responsible for ensuring that the property is ready for the shoot. This includes cleaning, decluttering, and staging as necessary. Our photographers will not move or alter any personal belongings or furniture at the property.

​

4.2. On-Site Requirements:
You are required to provide accurate details for the shoot, including specific angles, drone locations, and any other special requests. If you are unable to attend in person, the photographer will use their professional discretion for selecting the best angles and shots.

4.3. On-Site Cancellation:
If a session is cancelled once the photographer has arrived at the property, you will be charged the full session fee.

5. Usage and Licensing

​

5.1. License to Use:
Upon receiving full payment, you will be granted a license to use the images and videos for marketing and promotional activities related to the property. The media remains the intellectual property of Rainbow Media.

​

5.2. Restrictions on Third-Party Use:
The media provided to you is for your personal use and the use of your affiliated entities. You may not distribute, sell, or license the media to third parties without explicit written consent from Rainbow Media.

6. Delivery

​

6.1. Turnaround Time:
We will provide you with edited images and videos within 24 hours of the shoot date, unless otherwise specified.

​

6.2. Delivery Format:
The final deliverables will be provided in digital format through a secure download link sent to the email address you provided.

7. Copyright and Modifications

​

7.1. Copyright:
All images and videos produced by Rainbow Media are copyrighted to us. You are not permitted to alter, edit, or modify the media without prior written permission.

7.2. Photographer's Use:
Rainbow Media reserves the right to use the media produced for our portfolio, promotional materials, and social media platforms.

​

8. Quality and Revisions

​

8.1. Revision Process:
If you believe the delivered images or videos do not meet the agreed standards, please inform us within 48 hours of receiving the files. We will review your concerns and address any valid issues promptly.

9. Liability

​

9.1. Property Damage:
We take every precaution to avoid causing any damage to the property during the shoot. However, Rainbow Media is not liable for any damages that may occur during the session.

​

9.2. Limit of Liability:
Rainbow Media's liability is limited to the total amount paid for the services provided. We are not responsible for any indirect, incidental, or consequential damages.

​

​

10. Dispute Resolution

​

10.1. Mediation:
In the event of a dispute, both parties agree to attempt resolution through mediation before pursuing legal action.

​

11. Termination of Services

​

11.1. Termination by Rainbow Media:
Rainbow Media reserves the right to terminate the agreement if the Client fails to adhere to these terms. Any outstanding fees will still be due upon termination.

​

​

12. Governing Law

​

12.1. Jurisdiction:
These terms and conditions are governed by the laws of Queensland, and any disputes will be handled by the appropriate courts in this jurisdiction.

​

​

13. Updates to Terms

​

13.1. Amendments:
Rainbow Media reserves the right to update or modify these terms and conditions at any time. The latest version will always apply to future bookings.

​

​

14. Service Area and Travel Fees

​

14.1. Service Area:
Our primary service area is within 15km of Palm Beach. 

​

14.2. Travel Fees:
A travel fee will be charged for locations beyond our primary service area. Travel fees will be disclosed at the time of booking.

​

​

15. Agreement Acknowledgment

​

By confirming your booking with Rainbow Media, you acknowledge that you have read, understood, and agreed to these terms and conditions. You also affirm that all details provided for the shoot are accurate, including the property address, access instructions, and specific photo/video requirements.
